1. Acceptance of Terms
By accessing or using the TravelCore Collective website (the “Site”) and services provided by TravelCore Collective, a division of TravelMation (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or services.
2. Services Description
TravelCore Collective provides travel planning and booking services, including but not limited to vacation packages, cruises, destination weddings, corporate retreats, and related travel services. We act as an intermediary between you and travel suppliers (airlines, hotels, cruise lines, tour operators, etc.). We are not the provider of travel services but facilitate bookings on your behalf.
3. Booking and Payment
By making a booking through our services:
- You confirm that all information provided is accurate and complete.
- You agree to pay all fees and charges associated with your booking.
- You understand that deposits may be non-refundable as specified at the time of booking.
- You acknowledge that final payment deadlines are set by travel suppliers and must be adhered to.
- You accept that prices are subject to change until full payment is received and confirmed.
4. Cancellations and Refunds
Cancellation policies vary by travel supplier and booking type. We will inform you of applicable cancellation terms at the time of booking. Refund eligibility is determined by the travel supplier’s policies. We are not responsible for refunds denied by travel suppliers. Travel insurance is strongly recommended to protect against unforeseen cancellations.
5. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for acts, errors, omissions, representations, warranties, breaches, or negligence of any travel suppliers.
- We are not responsible for personal injury, property damage, or other losses arising from travel services provided by third parties.
- Our total liability shall not exceed the service fees paid directly to TravelCore Collective (excluding amounts paid to travel suppliers).
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
6. Travel Documentation
You are solely responsible for ensuring you have valid passports, visas, health certificates, and any other documentation required for travel. We provide guidance but cannot guarantee entry to any country. Denied entry due to insufficient documentation is your responsibility.
7. Intellectual Property
All content on this Site, including text, graphics, logos, images, and software, is the property of TravelCore Collective or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Privacy
Your use of our Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Notice and Cure Policy
Before initiating any legal action, claim, or complaint (including but not limited to lawsuits, arbitration, regulatory complaints, or demand letters) arising from or related to these Terms, our services, or this website, you must:
- Provide Written Notice: Send a detailed written notice to TravelCore Collective at [email protected] or by certified mail to our business address. The notice must include:
- Your full name, contact information, and booking reference (if applicable)
- A detailed description of the issue or alleged violation
- The specific relief or remedy you are seeking
- Supporting documentation (if available)
- Allow Cure Period: TravelCore Collective shall have sixty (60) calendar days from receipt of your notice to investigate and attempt to cure, correct, or resolve the issue to your reasonable satisfaction.
- Good Faith Negotiation: During the cure period, both parties agree to engage in good faith discussions to resolve the matter without litigation.
- Exhaustion Requirement: You may not pursue legal action until the cure period has expired and we have failed to adequately address the issue.
Waiver of Class Actions: Any claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.
10. Dispute Resolution
If the Notice and Cure process does not resolve your dispute:
- Binding Arbitration: All disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Location: Arbitration shall take place in Gwinnett County, Georgia, unless otherwise agreed.
- Governing Law: These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
- Small Claims Exception: Either party may bring qualifying claims in small claims court.
11. Indemnification
You agree to indemnify, defend, and hold harmless TravelCore Collective, TravelMation, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.
12. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this Site. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
